By accessing or using PatternPal (the "App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the App. PatternPal reserves the right to modify these terms at any time with notice to users.

PatternPal is available to users aged 13 and older. Users under 13 may use the App only with parental consent and supervision. All monetary donations must be made by someone 18 years or older. Parents and guardians are responsible for managing payment methods on devices used by minors.

By using PatternPal, you represent and warrant that you meet the age requirements and have the legal authority to enter into this agreement.

Account Creation: You are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account.

Account Security: You are responsible for keeping your password and account secure. PatternPal is not liable for unauthorized access to your account if you fail to maintain reasonable security measures.

Account Deletion: You may delete your account at any time. Upon deletion, all patterns associated with your account will be permanently removed from the App, and you will lose access to your account data. If you have distributed patterns outside PatternPal, you retain ownership of those patterns, but PatternPal is not responsible for managing them.

Account Inactivity: PatternPal currently does not delete inactive accounts. However, PatternPal reserves the right to implement an inactivity deletion policy in the future and will notify users of any changes before implementation.

Your Patterns: You retain full ownership and intellectual property rights to all patterns you create using PatternPal. You may use, modify, share, and sell patterns you create, provided you comply with all applicable laws.

Attribution: Every pattern created in PatternPal will automatically display the following at the bottom: "Made with PatternPal, the AI-assisted pattern creation app."

When Selling Patterns: If you sell a pattern you created with PatternPal for monetary compensation, you must include both a credit to PatternPal and a link to PatternPal (via our website, app store link, or social media) in your pattern listing or description.

Modified Patterns: If you modify the instructions of a pattern by 50% or more, attribution to PatternPal is not required.

PatternPal IP: PatternPal, including all code, design, graphics, and branding, is the exclusive property of Mullberry Farms LLC. You may not reproduce, distribute, or modify PatternPal without explicit permission.

Third-Party Artwork & Licensed Content: Users warrant that they own or have secured all necessary rights to any artwork, images, designs, or visual elements used in creating patterns on PatternPal. Users are strictly prohibited from incorporating commercially licensed artwork, branded logos, trademarked designs, or copyrighted imagery that they do not have explicit permission to use. Unauthorized use of such materials may result in content removal, account suspension, or termination, and may expose users to legal liability.

PatternPal uses artificial intelligence to generate patterns. You may optionally allow PatternPal to use your created patterns to train and improve our AI models, making PatternPal faster and more accurate for all users.

Your Choice: This is completely optional. You can toggle this setting ON or OFF at any time in your account settings. Your choice does not affect your access to PatternPal or your ownership of your patterns.

Default Setting: This setting is OFF by default. You must actively choose to enable it.

Your Patterns Remain Yours: Regardless of your choice, you retain full ownership of all patterns you create. PatternPal's use of patterns for AI training does not diminish your rights.

No Additional Compensation: You will not receive additional compensation for allowing PatternPal to use your patterns for AI training beyond access to the App.

No Warranties on Patterns: PatternPal does not guarantee the accuracy, completeness, or functionality of any pattern generated by the App. Patterns are provided "as-is."

User Testing Required: You are responsible for testing patterns before selling, sharing, or using them for commercial purposes. PatternPal is not liable for errors, inaccuracies, or patterns that do not work as intended.

Pattern Corrections: PatternPal relies on user feedback to improve pattern accuracy. You may submit corrections or improvements to patterns through the App's feedback feature.

PatternPal Not Liable: PatternPal is not responsible for any losses, damages, or issues resulting from the use of patterns created by the App, including but not limited to yarn waste, failed projects, or lost time.

Legal Compliance: You are responsible for verifying that any pattern you create complies with all applicable federal, state, and local laws regarding copyright, trademarks, and intellectual property.

When sharing or selling patterns created with PatternPal for monetary compensation, you agree to:

• Include a visible credit stating "Made with PatternPal, the AI-assisted pattern creation app"
• Include a working link to PatternPal (via our website, app store listing, or official social media accounts)

Failure to Comply: Users who consistently fail to provide proper attribution may face account warnings, suspension, or permanent bans.

Modified Patterns: If you modify the pattern instructions by 50% or more, attribution to PatternPal is no longer required.

What We Collect: PatternPal collects the following information to operate and improve the App:

• Email address (for account login and password recovery)
• Payment information (processed securely through third-party payment providers)
• Patterns you create and associated metadata
• Anonymized app usage statistics (e.g., which features are used most frequently)

What We Don't Collect: PatternPal does not collect location data, detailed behavioral tracking, or device fingerprinting.

How We Use Your Data:

• To provide PatternPal services
• To improve the App's functionality and user experience
• For future newsletters (opt-in)
• For PatternPal social media and marketing content
• To comply with legal obligations

Data We Do NOT Sell: PatternPal will never sell, rent, or share your personal data with third parties for their mailing lists, data brokerage, or commercial purposes.

Data Retention: PatternPal stores your data indefinitely unless you request deletion. You may delete your account and associated data at any time.

Third-Party Responsibility: PatternPal is hosted on Lovable and distributed through Apple App Store and Google Play. In the event of a data breach, the hosting and distribution providers bear responsibility for data security according to their respective policies.

Users are encouraged to review these third-party privacy policies to understand their security practices. PatternPal is not liable for data breaches caused by third-party service providers.

Voluntary Donations: PatternPal operates on a pay-it-forward donation model. All donations are completely voluntary and optional. You can use PatternPal in full without making any donation.

Donation Purpose: Donations support the continued development and operation of PatternPal, allowing us to keep the App free for all users.

Payment Processing: Donations are processed through third-party payment providers (such as Stripe or Square). PatternPal is not responsible for payment processing failures, delays, or issues caused by these third parties.

Donation Options: You may choose to make a one-time donation of any amount, set up a recurring monthly donation, or choose your own custom donation amount.

No Refunds Policy: All donations are final and non-refundable. However, if you believe you made a donation in error, you may request a refund within 24 hours of the transaction by contacting patternpalapp@gmail.com.

Age Requirement for Donations: Only users 18 years or older may make monetary donations. Parents and guardians are responsible for managing payment methods on devices used by minors.

No Guarantee of Future Features: Donations do not guarantee any specific features, updates, or continued operation of PatternPal. PatternPal may cease operations at any time.

You agree NOT to use PatternPal for any of the following:

• Harassment or Abuse: Attacking, threatening, or abusing other users
• Spam: Flooding the App with low-quality or repetitive patterns, comments, or messages
• Unauthorized Access: Hacking, attempting to breach, or gaining unauthorized access to PatternPal systems or user accounts
• Bulk Scraping: Downloading, copying, or extracting large quantities of patterns or data without authorization
• Impersonation: Pretending to be another person or entity
• Malware: Uploading or distributing viruses, malicious code, or harmful files
• Circumventing Attribution: Intentionally removing, hiding, or obscuring PatternPal credits or attribution requirements
• Selling App Access: Charging others to use PatternPal or reselling App access
• Automation & Bots: Using bots, scripts, or automated tools to artificially create patterns, inflate engagement, or manipulate the App
• Illegal Activity: Using PatternPal for any illegal purpose or in violation of applicable laws
• Unauthorized Resale of Patterns: Selling, distributing, or commercially exploiting patterns or pattern-derived products created by other users without explicit written permission from the original creator

PatternPal reserves the right to suspend or permanently ban users who violate these terms.

Pattern Removal Options: You may choose to remove a pattern from public access (make it private) — the pattern is no longer visible to others, but you can still access it; or delete a pattern entirely — the pattern is permanently removed from PatternPal and cannot be recovered.

When a pattern is removed or deleted, it will no longer be accessible in PatternPal. The App will display: "This pattern has been removed from public view by the user."

Exception: If someone has already downloaded a pattern to their personal computer, they may continue to use and keep that copy.

Account Enforcement: If you violate these Terms of Service, PatternPal will enforce the following escalating penalties:

1. Warning — You will be notified of the violation and given instructions to remedy it
2. Suspension — If the violation is not corrected within 24 hours, your account will be suspended for 30 days
3. Permanent Ban — If the violation persists after the 30-day suspension, your account will be permanently deleted and you will be banned from using PatternPal

Notification: Users will receive email notification of any account suspension or permanent ban at the email address associated with their account.

User Submissions: Community members may submit feedback, suggestions, feature requests, bug reports, and other submissions through PatternPal.

Ownership of Submissions: Any feedback, suggestions, or feature requests submitted to PatternPal become the property of PatternPal and may be used to improve the App without compensation to the user.

Community Voting: PatternPal periodically presents suggested features to the community for voting through Discord. Features that are voted on and implemented by the community become part of PatternPal.

Bug Reports and Fixes: PatternPal will review all bug reports and glitches. Once fixed, PatternPal will notify the community of the resolution. PatternPal maintains a public changelog of all fixes and implemented features for community reference.

TO THE FULLEST EXTENT PERMITTED BY LAW, PATTERNPAL AND MULLBERRY FARMS LLC SHALL NOT BE LIABLE FOR:

• App downtime, crashes, or interruptions in service
• Loss of data or patterns due to server failures
• Indirect, incidental, consequential, or punitive damages
• Lost profits, lost revenue, or lost business opportunities
• Third-party payment processor failures (Stripe, Square, etc.)
• User loss resulting from pattern inaccuracy or failure
• Any damages arising from your use or inability to use PatternPal

This limitation applies even if PatternPal has been advised of the possibility of such damages.

PatternPal is provided "AS-IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

PatternPal does not warrant that:

• The App will be error-free, bug-free, or uninterrupted
• Patterns generated will be accurate, functional, or suitable for your needs
• The App will meet your expectations or requirements
• The App will be available at all times without service interruptions
• All features will continue to exist indefinitely

You assume all risk associated with using PatternPal and the patterns it generates.

You agree to defend, indemnify, and hold harmless PatternPal, Mullberry Farms LLC, and their officers, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Patterns you create using PatternPal
• Your violation of these Terms of Service
• Your violation of any applicable law or regulation
• Claims by third parties that a pattern you created infringes their intellectual property rights
• Any other use of PatternPal by you

PatternPal is not liable for failure to perform services due to unforeseen circumstances beyond reasonable control, including but not limited to:

• Natural disasters
• Pandemics or epidemics
• Wars or acts of terrorism
• Government actions
• Major infrastructure failures
• Internet outages
• Other events beyond PatternPal's reasonable control

In such cases, PatternPal will make reasonable efforts to resume service and notify users of the situation.

PatternPal Termination: PatternPal reserves the right to cease operations or terminate the service at any time. In the event of service termination:

• All user accounts will be permanently deleted
• The community will be given the opportunity to vote on whether patterns should be preserved
• PatternPal will provide reasonable advance notice before termination

Users acknowledge that any patterns or data stored in PatternPal may be lost upon service termination.

PatternPal reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the App. Your continued use of PatternPal following any changes constitutes your acceptance of the new terms.

We recommend reviewing these Terms periodically to stay informed of any updates.

If any provision of these Terms of Service is found to be invalid, illegal, or unenforceable by a court of law, that provision will be severed, and the remaining provisions will continue in full force and effect.

These Terms of Service, along with any applicable privacy policy, constitute the entire agreement between you and PatternPal regarding your use of the App. These terms supersede all prior agreements, understandings, and discussions, whether written or oral.

Copyright Infringement: If you believe a pattern or content in PatternPal infringes your copyright or intellectual property rights, you may submit a DMCA takedown notice.

How to Report: Send your notice to pattern.pal.contact@gmail.com with the following information:

• Your name and contact information
• A description of the copyrighted work you believe has been infringed
• The specific pattern or content that infringes your rights
• A statement that you have a good-faith belief the use is not authorized
• Your signature (physical or electronic)

PatternPal's Response: Upon receipt of a valid DMCA notice, PatternPal will investigate the claim, remove the infringing content if warranted, notify the user who created the pattern, and take appropriate legal action if necessary.

Counter-Notices: If your pattern is removed due to a DMCA claim and you believe it is not infringing, you may submit a counter-notice with your contact information and a statement that you have a good-faith belief the content is not infringing.

You are responsible for maintaining the security of your account, including:

• Keeping your password confidential
• Not sharing your login information with others
• Immediately notifying PatternPal of any unauthorized access

PatternPal is not liable for unauthorized access to your account if you fail to maintain reasonable security measures or if you share your password with third parties.

PatternPal may link to third-party websites, social media platforms, or services (including our social media accounts). PatternPal is not responsible for the content, accuracy, or practices of these third-party sites.

Your use of third-party links is at your own risk and governed by their respective terms of service and privacy policies.

Informal Resolution: If you have a dispute with PatternPal, please contact us at patternpalapp@gmail.com. We will attempt to resolve the issue informally.

Binding Arbitration: If the dispute cannot be resolved through email support, you agree that any dispute will be resolved through binding arbitration in California, rather than in court. The arbitration will be conducted according to the rules of the American Arbitration Association (AAA).

No Class Actions: You agree that arbitration will be conducted on an individual basis and not as a class action or class proceeding.
